ATTORNEY GENERAL ISSUES CEASE AND DESIST ORDER AGAINST PREMIER TIMESHARE SOLUTIONS

BISMARCK, ND, December 9, 2009 – Attorney General Wayne Stenehjem yesterday issued a Cease & Desist Order against C & G Marketing Associates doing business as Premier Timeshare Solutions of Palm Beach Gardens, Florida, and its principals, Jose Goyos, also known as Jose Manuel Goyos, and Kristina Cameron for violations of North Dakota consumer fraud, home solicitation sales, and do not call laws.

According to Stenehjem, Premier Timeshare Solutions falsely promises timeshare owners that they have buyers for the consumers’ timeshares and then charges the consumers thousands of dollars in advance for services or sales that do not occur.

Consumers filed a complaint with the Consumer Protection Division indicating they paid $4,200 to Premier after Premier misrepresented it had buyers. The buyers never materialized and the sale never occurred. The consumers repeatedly attempted to contact Premier who either never answered the calls or its message box was full and would not accept their messages. The consumers were informed their file had been referred to Premier’s “refund department,” but they have never received any refund.

Stenehjem directed the Consumer Protection Division to investigate the complaint. Premier failed to respond to an initial inquiry from the Consumer Protection Division. The investigation, however, reveals a pattern of complaints elsewhere in the country. “Premier’s deceptive sales practices constitute an absolute scam. Premier’s claims that they have buyers for the timeshares are untrue and are nothing more than a ruse to obtain money under false pretenses,” Stenehjem said. “This conduct in North Dakota will be prosecuted.”

According to Parrell Grossman, director of the Consumer Protection Division, consumers should be very cautious about services that claim to sell timeshares.

“These entities charge significant fees to either take or sell a consumer’s timeshare property, and owners should first carefully consider other legitimate alternatives,” Grossman said.
