The much deliberated question of would Four Seasons stay or would they go has finally been answered, but what now?
Carlsbad, CA (April 28, 2010) — The clash between Four Seasons Hotels and the owners (Broadreach Capitol and its partner Maritz, Wolff and co) of the stunning 329 room Aviara hotel, situated in the California coastal community of Carlsbad, drew to a close early last week. After almost one year in limbo, it was decided by an arbitration panel, that the dispute, which originated over accusations of mismanagement of the hotel, was finalized. The findings by that arbitration committee were that Four Seasons did not breach the management agreement or its fiduciary duties to the owners. The panel determined, however, that both parties contributed to the demise of their business relationship and that the management agreement should be terminated, according to a joint statement by Four Seasons and the owners.
Shortly after the announcement of the arbitration decision, Broadreach and co-owner Maritz, Wolff and Co., announced that they had selected Hyatt to manage Aviara as part of it’s luxury Park Hyatt portfolio. With the announcement of the management change, some questions regarding the management of the timeshare interests on the property have emerged. While some owners are relieved that a resolution has finally emerged, others are still uncertain as to how this will effect their ownership interests.
The Four Seasons Aviara property has been selling timeshare interests at its Aviara location for more than a decade with a tally of owners well over three thousand. The timeshares, known as the Aviara Residence Club, consist of 132 timeshare villas, located in two separate villages surrounding the hotel. Boasting up to 1700 square feet of luxury accommodations in their 2 bedroom villas and 1300 square feet in the 1 bedrooms, the Residence Club timeshares are arguably some of the finest timeshares in the world. Owners who wish to sell their ownerships, up to this point, have relied on off-site resale companies who, in some cases, charge up-front listing fees in order to “attempt” to find buyers for their ownerships will now have the opportunity to deal with a licensed California Real Estate Brokerage located within the Aviara community to assist in finding buyers for their property through the launch of Aviara Resales a division of Aviara Resort Properties.
