July 27, 2012 — Then, about 65 million years ago after the dinosaurs died off and several ice ages passed, laws were formed governing the marketing and sales of Timeshare intervals in order to protect the surviving forest creatures from bloodthirsty carnivores, predators, evil-doers, malcontents and hooligans!
So here’s the scoop. Take for example the State of Hawaii 514E Hawaii Revised Statues (HRS) as well as their “Hawaii Administrative Rules, Title 16 of the Department of Commerce and Consumer Affairs, Chapter 106 – Time Sharing”.
A reader of ‘The Gate’ who recently purchased a TS interest in Hawaii contacted us regarding rescinding their contract and in order to answer their questions thoroughly I was selected, and, against my will, forced to read all chapters (laws) regarding the Aloha State’s TS Statutes.
After reading thousands of words, cross checking relevant statutes, etc. and e-mailing answers back to the new owner I found myself wondering if, as an industry, our past deeds were really so mischievous as to cause Hawaii legislators to enact such stringent and restrictive laws regarding TS sales activities, including all marketing and sales personnel?
I also discovered that it was not just the State’s ‘attitude’ but while the hopeful timeshare licensees are enduring the government intrusion and anal probing into their personal lives many TS companies there (and elsewhere) are also requiring full background checks, urine and/or blood analysis, credit reports, school records and former employer references, etc. before they hire a ‘rep’.
And then, should the hopeful ‘vacation counselor’ make it through the nearly endless labyrinth they must also pay hundreds of dollars to attend an accredited school (which can take up to a month or longer to complete), pass the school test and then (usually) pass a ‘national’ test before they can finally obtain that license (or permit) so they can fend for their families.
I’m not picking on Hawaii (or the developers) and ‘Inside The Gate’ we do have a list of the licensing requirements of each U.S. State published for those interested. And although each jurisdiction differs in terms of how deep of a colostomy they perform the majority of these government bodies treat timeshare and TS marketing and sales reps as if they are known slashers the likes of ‘Jason’ (Voorhees) or ‘Freddy’(Krueger) of “Friday The 13th” and “A Nightmare on Elm Street” (respectively).
And yes, as I have often written, there are ‘heat-merchants’ (liars) who have and continue to work in the ‘biz’ and who don’t play well with others. But IMO, many of these ‘laws’ go too far and trample, as they do in Hawaii, a ‘vacation counselor’s’ State and Federal Constitutional rights such as freedom of speech, rights to privacy, etc.!
But what I find most disturbing is simply this. In the Hawaii State Constitution (and the U.S. Federal, too) the people’s ‘right to keep and bear arms’ is alive and doing quite well thank you very much.
So much so that any crazed lunatic can attend a weekend Gun Show, get online or visit a local retail arms dealer and purchase as many killing apparatuses as their little hearts desire (ammo, too).
But if that same person— or anyone else— wants to obtain a TS license in order to become a dreaded OPC (Outside Public Contact) or sales rep and earn a living? Well, not so fast there, Pardner!
